Your Constitutional Rights

These rights apply to everyone in the United States, regardless of immigration status.

Right to Remain Silent

You have the right to remain silent and do not have to answer questions about your immigration status, where you were born, or how you entered the country. Clearly state: "I am exercising my right to remain silent."

Right to Refuse Entry

ICE cannot enter your home without a warrant signed by a judge. A deportation or removal order is not a warrant. Ask them to slide it under the door and check the signature. Do not open the door.

Right to Refuse a Search

You have the right to refuse a search of your belongings, your car, or your home. Clearly say: "I do not give you permission to search." Refusing a search is not an admission of guilt.

Right to an Attorney

If you are detained, you have the right to speak with a lawyer before answering any questions. Say: "I want to speak to a lawyer." Do not sign anything without legal counsel.
